This advanced session explores strategies and techniques for responding to evasive, non-responsive, forgetful, and uncertain answers; attacking the accuracy and/or credibility of a harmful answer; undermining opinions and conclusions; and responding to inconsistent and implausible answers. The speakers also share their tips on how to avoid framing errors that lead to objections and other interruptions, and provide a framework for effectively responding to typical deposition objections, inappropriate instructions not to answer, and improper coaching, speaking objections, harassment, obstructionism, posturing, or other dilatory tactics.

She taught trial advocacy and pretrial at St. Louis University School of Law and Washington University School of Law for more than ten years, and taught trial, pretrial, negotiation, class actions and discovery courses for EEOC’s Office of General Counsel for more than fifteen years. EEOC named her an ABA Fellow in 2002, and she served as an active speaker and member of the ABA’s Class and Complex Litigation Subcommittee for 3 years. She has served on the Boards of the Women Lawyers Association of St. Louis and the St. Louis Chapter of the National Employment Lawyers Association, and is currently President-elect of the St. Louis NELA Chapter. She served on National NELA’s Judicial Nominating Committee, and is currently the Chair of the Magistrate Judge Merit Selection Panel for the Eastern District of Missouri. He specializes in complex class and collective actions on behalf of plaintiffs, including employment discrimination, ERISA, and wage-and-hour actions, and breach-of-contract actions on behalf of foreign nationals working in the United States. Mr. Hutchinson has also pursued a series of consumer protection cases against major banks and financial services providers. His efforts helped result in the largest monetary settlement in the history of the Telephone Consumer Protection Act and ended harassing automated calls to millions of consumers. He presented papers on Title VII class actions at national employment law conferences, including conferences by the American Bar Association’s Section of Labor and Employment Law, the Impact Fund, the UCLA School of Law, and the Consumer Attorneys of California. Mix graduated from Middlebury College, cum laude, with a degree in English. She obtained her J.D. from the University of Colorado School of Law and practiced law in Denver until 2007, when she was appointed to the federal bench. Magistrate Judge Mix’s expertise prior to her appointment was in labor and employment law. In 2006 and 2007, Judge Mix was recognized as a top employment lawyer by Chambers U.S.A. and named one of the top twenty-five women lawyers in Colorado by 5280 Magazine. Magistrate Judge Mix was recently appointed by Chief Justice John Roberts to serve on the Judicial Conference of the United States’ Committee on the Administration of the Magistrate Judge System. She also serves on the United States District Court for the District of Colorado’s Local Rules Committee, Case Management Review Committee, and Human Resources Task Force. She is the Tenth Circuit Director to the Federal Magistrate Judges’ Association and chaired the FMJA’s 2012 Convention Committee. Magistrate Judge Mix serves as the Chair of the Colorado Commission on Family Medicine, is a member of the Board of Directors of the Colorado Family Medicine Institute, and is on the faculty of the National Institute of Trial Advocacy.
