What is the difference between Title VII of the Civil Rights Act and 42 U.S.C. 1981? Most of us think the answer to this question is damages caps and that we can allege a §1981 claim for race discrimination. But, what is “race” under §1981? What is the difference between a race claim under §1981 and a national origin or race claim under Title VII, and does it matter? The answer is an emphatic “yes”!
