Plaintiffs’ employment attorneys do good work. But the pursuit of goodness is occasionally marred by pitfalls. In particular, an attorney’s efforts to assist clients can often lead to ethical dilemmas that threaten the sanctity of the attorney-client relationship. Even more, serious ethical dilemmas can put an attorney’s legal career at risk. Can an attorney pressure a client to accept a settlement so that the attorney, working on a contingency basis, can more promptly receive payment? What costs/expenses can an attorney/law firm advance to clients? Can an attorney represent multiple clients who have claims against the same defendant, but whose cases may have different levels of liability and different values? When, and for what reasons, can an attorney end the attorney-client relationship? These are just a sample of some of the ethical considerations that attorneys’ may face in representing employees.

Merry has practiced employment law in Boston since 1990 with emphasis on representing employees in race, sex, age, religion, disability, and national origin discrimination matters; and wrongful discharge, non-competition agreements, and employment contracts. He also teaches at Suffolk University Law School. Mr. Merry served for two years as general counsel and chief of enforcement for the Massachusetts Commission Against Discrimination; for ten years as an assistant attorney general; and for a year as a law clerk to the Massachusetts Superior Court. Mr. Merry serves on the Executive Board of the National Employment Lawyers Association (NELA), and is a Board representative on NELA’s Ethics and Sanctions Committee. Mr. Merry is a member of the College of Labor and Employment Lawyers, a past chair of the Massachusetts Employment Lawyers Association, and a member and past president of the board of trustees of the Massachusetts Law Reform Institute. A member of the Massachusetts and American Bar Associations, Labor and Employment Law Sections, he has served as chair of the Individual Rights and Responsibilities Section of the Massachusetts Bar Association. He is also the author of numerous articles on employment law and a frequent lecturer at continuing education programs relating to discrimination law and employment law generally. Silver is a Senior United States District for the District of Arizona, where she has served since her appointment in 1994. She was the first woman appointed in the Phoenix Division and the second woman appointed in the District of Arizona. In 2011 she became the first woman Chief Judge for the District of Arizona. Prior to her appointment to the bench, Judge Silver was Criminal Division Chief and acting First Assistant for the U.S. Attorney’s Office in Phoenix. She taught as a professor for the American Institute of Paralegal Studies and at the Arizona State University Center for Executive Development. She now teaches at the Arizona State University Law School, a Law Science Cluster Group, and Master of Legal Studies in Constitutional Law. She also teaches Criminal Law at the University of Regensburg, Germany. Judge Silver is a lecturer for the American Conference Institute, and has published articles in numerous journals, including Arizona Attorney magazine, the ABA Journal, and the Maricopa Lawyer, and has been a contributing editor to the Federal Civil Procedure Before Trial Practice Guide (Rutter Group). She was chair of the Ninth Circuit Article III Judges Education Committee and the District of Arizona Local Rules Committee.
