David Frederick represents clients across a broad spectrum, principally in appellate courts. In the
Supreme Court, he has represented individuals, investors, immigrants, classes of consumers, Native Americans, small corporations, trade associations, large companies, foreign governments, and States. His practice encompasses a wide array of subject matters, with currently pending matters involving interstate equitable apportionment of river waters and underground aquifers, mutual fund investment adviser fees, securities fraud, electricity rate charges arising out of the California energy crisis, cable television programming carriage, ERISA, antitrust, False Claims Act, federal employee health benefits, and employee overtime liability. He has argued twenty-nine cases in the Supreme Court and in every U.S. court of appeals. The second edition of his book, Supreme Court and Appellate Advocacy has just been published by West (2010). He also is the author of The Art of Oral Advocacy and Rugged Justice: The Ninth Circuit Court of Appeals and the American West, 1891-1941. He is a partner at Kellogg,
