David L. Kern graduated from the University of Texas at El Paso in 1979 and received his J.D. degree from the University of Texas School of Law in Austin, Texas in 1983 where he served as a Note Editor on the Texas Law Review. He is licensed to practice law in Texas and the District of Columbia and has been Board Certified in Labor and Employment Law by the Texas Board of Legal Specialization since 1993. Mr. Kern’s fellow lawyers have recognized him in The Best Lawyers In America (2005–2012) and Texas Super Lawyers (2006–2012). Mr. Kern’s law practice includes FLSA collective actions, Title VII, ADEA, ADA, sexual harassment, workplace safety, retaliation, and whistleblower cases as well as traditional labor law. For nearly 20 years, he has conducted a nationwide practice in the representation of large groups of current and former employees in wage and hour class actions, successfully representing thousands of individuals in such matters throughout Texas, as well as in Arizona, California, Colorado, Florida, Hawaii, Illinois, Indiana, Kansas, Louisiana, Michigan, Mississippi, New Mexico, New York, Rhode Island, Virginia, Washington (state), and Washington, D.C. Mr. Kern is a frequent author and speaker on labor and employment law topics and has spoken at numerous local, regional, and national seminars as well as internationally at seminars in both Canada and Mexico. Since 1990, Mr. Kern has been an active member of the National Employment Lawyers Association (NELA). He presently serves on the National Executive Board of NELA, the Board of Directors for the Texas Employment Lawyers Association (TELA), and as the NELA/TELA Liaison to the West Texas Employment Lawyers Association (WTELA). Mr. Kern is also a longtime member of the American Association for Justice (AAJ) (formerly ATLA) and the National Lawyers Guild (NLG).
