Molly A. Elkin is a partner in the law firm of Woodley & McGillivary in Washington, D.C. where she specializes in representing unions and employees in class actions and large multi-plaintiff wage and hour litigation. Prior to joining Woodley & McGillivary in 1996, she served as Assistant Counsel for the National Treasury Employees Union. Ms. Elkin has successfully represented unions and employees in over 75 Fair Labor Standards Act overtime pay cases in court and in arbitration. She served as lead counsel in Jordan v. Tyson Foods, which resulted in a summary judgment decision in favor of the plaintiffs on issues involving donning and doffing and the measure of the compensable continuous workday. She also served as lead counsel for the prevailing plaintiffs in numerous First Amendment lawsuits involving public sector employees in federal district courts which resulted in jury verdicts in favor of the plaintiffs. From 2003- 2009, Ms. Elkin was the Union- Employee Co-Chair of the ABA’s Labor and Employment Section’s Federal Labor Standards Legislation committee which has jurisdiction over the FLSA. From 2003 through 2005, she was the Chair of the District of Columbia Bar’s Steering Committee for Labor and Employment Law. She is a 1993 honors graduate of George Washington University School of Law.
