Dawson Morton represents farmworkers at the Farmworker Rights Division of Georgia Legal Services, a non-profit legal services provider. Mr. Morton is a 1995 graduate of Reed College and a 1999 graduate of NYU Law. Since 1999, Mr. Morton has been litigating Fair Labor Standards Act (FLSA) cases for farmworkers in Georgia, many who are temporary “guestworkers” in the United States on H-2A visas. Mr. Morton’s practice is primarily federal litigation for FLSA minimum wage violations and for breach of employment contracts. A perennial issue in Mr. Morton’s suits for workers paid on a piece rate is the reconstruction of the real hours worked and the uncovering of the employer’s method for reducing hours worked in order to avoid the legal requirement to supplement piece-rate pay. A recent disappointing outcome of an appeal in which Mr. Morton argued that evidenced farmworkers’ hours violated Anderson v. Mt. Clemens Pottery highlights the persistent challenge many farmworkers and their advocates face to construct accurate wage and hour records.
