James Kan is an associate at Goldstein Demchak Baller Borgen & Dardarian, which is a plaintiffs’ side firm based in Oakland, California that specializes in complex labor and employment law practice in California and nationwide. He has litigated numerous race discrimination and wage and hour class actions, wage and hour collective actions, as well as environmental justice matters. In 2009, Mr. Kan served as co-trial counsel in a FLSA collective action in the Southern District Court of Houston, Roussell v. Brinker Int’l Payroll Co., Inc., where the plaintiffs obtained a successful jury verdict and bench ruling regarding illegal tip pool practices at Chili’s Bar and Grill restaurants. The case has been appealed by defendant and is currently awaiting decision from the Fifth Circuit Court of Appeals. Mr. Kan received his B.A. from the University of North Carolina at Chapel Hill and his J.D. from Columbia University School of Law.
