The increasingly prominent role ESI plays in the discovery process has created challenges on both sides of the bench. By understanding the perspectives of those charged with applying the procedural and evidentiary rules to new and emerging forms of discovery, and resolving disputes that may arise, employee rights advocates can engage more productively with the court and opposing counsel during the discovery process.
